1. Scope
These Terms of Service govern your access to and use of the Smart Resize Photoshop plugin, website, and related licensing services. By purchasing, downloading, installing, or using Smart Resize, you agree to these terms.
2. License Grant
Smart Resize grants you a non-exclusive, non-transferable, revocable license to use the plugin during your valid lifetime license period. Each purchased license key may be activated on up to the machine limit provided with that key.
3. Activation, Verification, and Machine Limits
The plugin uses server-side activation and verification to validate license status and enforce machine limits. If you reach your machine limit, you may need to deactivate a previously activated machine before activating a new one.
4. One-Time Billing (Lifetime License)
Smart Resize is sold as a one-time lifetime license purchase, billed in advance at checkout. There are no automatic renewals. Pricing, taxes, and invoice details are presented at checkout. Payment processing is handled by Lemon Squeezy.
5. Refunds
We offer a 30-day money-back guarantee for new purchases. To request a refund, contact hello@kokoro.cool within 30 days of payment. Approved refunds are issued through the original payment provider.
6. Restrictions
You may not: (a) share, resell, or sublicense your license key; (b) circumvent activation, verification, or machine limits; (c) reverse engineer, decompile, or attempt to extract source code except where required by applicable law; (d) redistribute the plugin or proprietary assets.
7. Intellectual Property
Smart Resize and all related software, branding, and materials are owned by Smart Resize and protected by intellectual property laws. These terms grant you a limited right to use the software, not ownership.
8. Updates and Service Changes
Lifetime licenses include updates published by Smart Resize. We may modify, improve, or discontinue features over time. We may also update these terms when needed, and continued use indicates acceptance of the updated version.
9. Disclaimer of Warranties
Smart Resize is provided on an "as is" and "as available" basis, without warranties of any kind, express or implied, including merchantability, fitness for a particular purpose, and non-infringement.
10. Limitation of Liability
To the maximum extent permitted by law, Smart Resize is not liable for indirect, incidental, special, consequential, or punitive damages, or any loss of data, revenue, or business interruption related to your use of the plugin.
11. Termination
We may suspend or terminate access to Smart Resize for fraud, abuse, chargebacks, or material violations of these terms. On termination, your license rights end, except where required by applicable law.
